3. User Responsibilities

You agree to:

  • Not use Services for illegal activities (e.g., spam, hacking, fraud).

  • Comply with our Acceptable Use Policy (below).

  • Maintain account security (e.g., passwords, 2FA).

4. Acceptable Use Policy (AUP)

Prohibited activities include:

  • Spam/Phishing: Unsolicited emails or fraudulent schemes.

  • Illegal Content: Child exploitation, piracy, or hate speech.

  • Resource Abuse: Overloading servers (e.g., cryptocurrency mining).

  • Bypassing Security: Unauthorized access or reverse engineering.

Violations may result in account suspension or termination.

5. Payments & Billing

  • Fees are auto-renewed unless canceled 15 days before renewal.

  • No refunds for domain registrations, setup fees, or violations of these Terms.

  • Chargebacks incur a $50 fee and may lead to account termination.

6. Termination

We may suspend or terminate accounts for:

  • Non-payment.

  • AUP violations.

  • Legal compliance (e.g., court orders).

7. Disclaimers & Limitation of Liability

  • No Warranty: Services are provided “as is.” We do not guarantee uptime, data security, or fitness for a specific purpose.

  • No Liability: We are not liable for:

    • Data loss, breaches, or corruption.

    • Third-party actions (e.g., domain registrars, payment processors).

    • Damages exceeding fees paid in the last 3 months.

8. Indemnification

You agree to indemnify FlameGrower LLC against claims arising from:

  • Your misuse of Services.

  • Violations of these Terms.

9. Dispute Resolution

  • Governing Law: Texas law applies.

  • Jurisdiction: Disputes must be filed in Harris County, TX.

  • No Class Actions: Claims must be individual.

10. Changes to Terms

We may update these Terms. Continued use = acceptance.
